9.3 Fines

The Fine structure is as follows for said violations:

A. Chain link dog pen not seen from the street in which your house faces or on a lake. (section 7.25) Fine assessed per day $20.00.

B. Mailbox that is in violation of section 7.20 of the Declaration of Covenants and Restrictions for Easterly Lakes First, Second, Third, Fourth and Fifth Filings and Dedication and transfer of of Common Properties. Fine assessed per day $15.00 with compliance of 10 days.

C. Violation of section 7.17 Parking and Storage: No house trailers, recreational vehicles, trailers, school buses, boats, motor homes, commercial vehicles, trucks (except pick up trucks) go carts, bicycles, or toys shall be kept, stored, parked, repaired or maintained on any lot, street, servitude or right of way, in such a manner as to visible from the lake or visible from the street on which the lot fronts. Fine of $250 plus $25.00 per day.

D. Fence Construction without prior ACC written approval (section 7.25) Fine of $500.00 with compliance of 2 days.

E. Pool started without prior ACC written approval (section 7.6) Fine of $500.00 with compliance of 2 days.

F. House started without prior ACC written approval (section 7.6) Fine of $2,500.00 with compliance of 2 days.

G. Grass Cutting/Noxious Weeds that is in violation of (section 7.24) in event an owner fails to mow the grass, maintain servitude, cut the weeds, or clean up the trash or garbage within seven (7) days after receipt of written demand from the Association, the Association may cut, or clean the home. The actual cost incurred by the Association in connection therewith shall be deemed to be an additional assessment against the Home and the Owners thereof may be assessed, together interest, fees, and cost, the same as a regular Home assessment under Article VI of the restrictions.

H. Commercial Business may not be conducted as per (section 7.1) Fine $50.00 per day with Compliance of 10 days.

I. Any additions or any construction of any kind, attached or not attached to your home require approval from the ACC in writing. Failure to comply will result in $1,500.00 fine and a $150.00 per day assessment until approved.

Any assessment, fine, or penalty or other levy which is not paid within thirty (30) days of its due date shall be delinquent. If an assessment, fine or penalty, or any other levy is not paid within thirty (30) days of their due date, the levy shall bear interest from the date of delinquency at the rate of twelve percent (12%) per annum. The Association may bring an action of law, i.e. judgement against the owner personally obligated to pay the same and/or “in rem” against the current owner of the Lot assessed, to recover the amount of the assessment, fine, penalty, or any other levy provided for herein or in the Restriction or the Articles of Incorporation by non -use of the common Properties or abandonment of the affected lot.

The above stated fines will be assessed five (5) days from receipt of a certified letter of Notification.
